MEASURES (INCLUDI JG LEGISLATION OR POLICY) TAKEN BY GHANA TO IMPLEMENT THE PROVISIONS OF THE CHARTER CIVIL AND POLITICAL RIGHTS Articles 2 and 3 of the African Charter Article 2 Every individual shall be entitled to the enjoyment of the rights and freedoms recognised and guaranteed in the present charter without distinction of any kind such as race, ethnic group, colour, sex, language, religion, political or any other opinion, national and social origin, fortune, birth or other status. Article 3 1 Every individual shall be equal before the law 2. Every individual shall be entitled to equal protection of the law. THE GHANAIAN CONSTITUTION Article 12 of the 1992 Constitution provides: 1. The fundamental human rights and freedoms enshrined in this chapter shall be respected and upheld by the Executive, Legislature and Judiciary and all other organs of government and its agencies and, where applicable to them, by all natural and legal persons in Ghana, and shall be enforceable by the courts as provided by the Constitution. 2. Every person in Ghana, whatever his race, place of origin, political opinion, colour, religion, creed or gender shall be entitled to the fundamental human rights and freedoms of the individual (contained in this chapter) but subject to respect for the rights and freedoms.
