CHAPTER 4 Article 4 Human beings are inviolable. Every human being shall be entitled to respect for his life and the integrity of his person. No one may be arbitrarily deprived of this right. Right to Life 131. The right to life in Zambia is considered as the most important basic human right. It therefore deserves utmost guarantee and protection. In order to achieve the right to life, the following measures have been taken: A. LEGISLATIVE MEASURES The Constitution 132. The right to life is protected by Article 12 of the Constitution which provides – “(1) A person shall not be deprived of his life intentionally except in execution of the sentence of a court in respect of a criminal offence under the law in force in Zambia of which he has been convicted. (2) A person shall not deprive an unborn child of life by termination of pregnancy except in accordance with the conditions laid down by an Act of Parliament for that purpose. (3) Without prejudice to any liability for a contravention of any other law with respect to the use of force in such cases as are hereinafter mentioned, a person shall not be regarded as having been deprived of his life in contravention of this Article if he dies as a result of the use of force to such extent as is reasonably justifiable in the circumstances of the case- 68
