misbehaviour, after a tribunal appointed to investigate the allegations confirms such allegations and recommends that a Judge be removed. The Judiciary’s independence is further protected as the salaries payable to the Judges and their terms of office may not be altered to their disadvantage after their appointment. 67. The laws, which are applied by the different Courts, which form the Judicature, fall into three broad categories: (a) Legislation (i) In the form of Acts of Parliament and subordinate legislation made under those Acts. (ii) English Laws (Extent of Application) Act, Chapter 10 of the Laws of Zambia provides that all English statutes in force in England in 1911 are applicable in Zambia as long as the law is not inconsistent with existing Zambian laws, and the Act is to be applied in the light of prevailing local circumstances. In matrimonial causes English laws are still applicable; (b) Judicial precedents, which are rules, derived from decisions of the High Court and Supreme Court of Zambia; and (c ) Customary law, which is applicable in so far as it is not inconsistent with existing statutory laws or repugnant to the principles of natural justice, equity and good conscience. 68.
