Constitutional and Judicial Measures
Section 40 of the Constitution of Nigeria 1999 guarantees the right to freedom of
assembly subject to the constitutional limitations of reasonably justifiable in a democratic
society such as in the interest of defence, public safety, order, morality or health or for
the protection of the rights of other persons.
Public assembly is an essential part of the activities of political parties, trade unions,
religious bodies, professional associations etc.
Further, political parties and their candidates shall not use places of worship,
police stations and other public offices for political rallies, campaigns and processions.
