agricultural land. Further, the audit outcome will be of utility in
enhancing the one-person one-farm policy; thus, improving access
to agricultural land and equitable distribution of property.
14.Article 15: Right to Work
Constitutional and Legislative Measures
14.1. The Constitution provides for the right to work. Furthermore the
Constitution obligates the State and institutions of Government at
every level to adopt reasonable policies and measures to ensure
that its citizens enjoy the right to work, safe legal practices and
standards, and to be paid a fair and reasonable wage67.
14.2. The Labour Act governs the right to work for all persons other
than those whose conditions of employment are governed by the
Constitution. The Act seeks to advance social justice and
democracy at the work place. There are no legal restrictions on
one’s choice of work. The laws in place protect and respect the
right to work68.
14.3. The Labour Act also prohibits forced labour, thereby guaranteeing
everyone the right to freely engage in the employment of their
choice. Contravention of this provision attracts a fine and or
imprisonment for a maximum term of two years. The Act thus
incorporates the provisions of the two fundamental ILO
conventions on the elimination of forced labour69 which Zimbabwe
ratified in 1998.
14.4. The Act further establishes the Labour Court which has
jurisdiction to hear appeals and applications, and can exercise the
same powers as the High Court in relation to labour matters.
Appeals from the Court’s decisions on questions of law lie with the
Supreme Court.
