Article 7 of the African Charter Article 7 Every individual shall have the right to have his cause heard. This comprises: a. The right to an appeal to competent national organs against acts violating his fundamental rights as recognized and guaranteed by conventions, laws, regulations and customs in force; b. The right to be presumed innocent until proved guilty by a competent court or tribunal; c. counsel of his choice; d. The right to be tried within a reasonable time by an impartial court or tribunal. 2. No one may be condemned for an act or omission, which did not constitute a legally punithable offence at the time it, was committed. No penalty may be inflicted for an offence for which no provisions was made at the time it was committed. Punishment is personal and can be imposed only on the offender. THE GHANAIAN CONSTITUTION Article 19 of the Constitution 1. A person charged with a criminal offence shall be given a fair hearing within a reasonable time by a court 2. A person charged wita a criminal offence shall: a. in the case of an offence other than high treason or reasons, the punishment for which is death or imprisonment for life, be tried by a judge and jury and where the punishment is death the verdict of the jury shall be unanimous; and in the case of life imprisonment, the verdict of the jury shall be by such majority as Parliament may be law prescribe;
