43. In view of the foregoing, the Commission makes the following recommendations to the government of South Africa: Reporting Obligations and Cooperation with the Commission 44. The Commission recommends that South Africa should ensure it complies with its obligations under Article 62 of the African Charter and 26 of the Maputo Protocol by implementing these recommendations: Ratification of Regional/International Human Rights Instruments 45. Make a declaration under Article 34(6) of the Protocol to the African Charter on the Establishment of the African Court on Human and Peoples' Rights and lift all reservations under the Maputo Protocol in line with the spirit of the Protocol. 46. Ratify the following human rights instruments: i. ii. African Charter on Statistics; African Union Convention for the Protection and Assistance of Internally Displaced Persons in Africa (the Kampala Convention); iii. African Union Convention on the Elimination ofMercenaries in Africa; iv. African Union Convention on Cyber Security and Personal Data Protection; v. vi. vii. viii. ix. The Protocol on the Statute ofthe African Court ofJustice and Human Rights; Indigenous and Tribal Peoples Convention; Optional Protocol to the Convention against Torture and Other Cruel, Inhuman and Degrading Treatment or Punishment (OPCAT); Optional Protocol to the International Covenant on Economic, Social and Cultural Rights; International Convention on the Protection of the Rights of All Migrant Workers andMembers of their Families; and x.
