East African Community Court of Justice Rules of Procedure, 2019. 94. (1) Subject to the provisions of sub-rule (3) of this rule and to any other rule allowing informal applications, all applications to the Court shall be by a notice of motion, which shall state the grounds of the application. Form of applications to the Court / Appellate Division. (2) A notice of motion shall be in the format provided for in Form A in the Seventh Schedule to these Rules and shall be signed by or on behalf of the applicant. (3) The provisions of this Rule shall not apply:— (a) to applications made in the course of hearing which may be made informally; or (b) to applications made by consent of all parties which may be made informally by letter. 95. (1) Every formal application to the Court shall be supported by one or more affidavits of the applicant or of some other person having knowledge of the facts in accordance with Form 3 of the Second Schedule to this Rules. Supporting documents. (2) An applicant may, with the leave of the Court or with the consent of the other party, lodge one or more supplementary affidavits, and an application for such leave may be made informally. 96. (1) Subject to the provisions of Rule 131, an appeal shall be instituted by lodging in the appropriate registry, within thirty (30) days of the date when the notice of appeal was lodged:— (a) a memorandum of appeal, in eight (8) copies; (b) the record of appeal, in eight (8) copies; and (c) payment of Five hundred United States Dollars (500 USD) as security for costs of the appeal. (2) Notwithstanding sub-rule (1)above where an application for a copy of the proceedings in the First Instance Division has been made within thirty (30) days of the date of the decision 57 Institution of appeals.
