to ratification by the National Assembly and is the principal legal adviser to the State. The Attorney General is not subject to the direction or control of any other person or authority in the discharge of duties. The Attorney General is charged, interalia, with representing the State in all civil proceedings to which the State is a party. The Attorney General is also an ex officio member of Cabinet. 69. The Office of the Solicitor-General is established by Article 55 of the Constitution. He is appointed by the President subject to ratification by the National Assembly. The Solicitor-General deputizes the Attorney- General and exercises any power or duty imposed on the AttorneyGeneral by the Constitution or any other written law whenever the Attorney-General is unable to act owing to illness or absence or where the Attorney-General has authorized the Solicitor-General. 70. The Director of Public Prosecutions is appointed by the President subject to ratification by the National Assembly. The office of Director of Public Prosecutions is established by Article 56 of the Constitution. The Director of Public Prosecution has the power: a) to institute and undertake criminal proceedings against any person before any court, other than a court martial, in respect of any offence alleged to have been committed by that person; b) to take over and continue any such criminal proceedings as have been instituted or undertaken by any other person or authority; and, 46
