Courts   continue   to   use   ADR   as   a   compulsory   initial   step   in   the   resolution   of   commercial   disputes.   29.5   percent   of   Respondents   were   of   the   opinion   that   judgments   handed   over   in   the   courts   were  not  fair  (Figure  16).  There  is  a  perception  among  Respondents  that  judgments  favour  the   rich  or  those  with  “connections”  to  judges.     The   Judicial   Service,   in   an   attempt   to   promote   confidence   in   the   public   in   the   judicial   system   has  established  a  Judicial  Complaints  Unit,  headed  by  a  retired  Supreme  Court  Judge  has  been   established  in  order  to  address  public  complaints.     The   Judicial   Service   promoted   the   sitting   of   the   courts   on   Saturdays   to   address   the   huge   backlog  of  unsettled  cases  in  the  law  courts.     3.11   CHRAJ’s  capacity  to  execute  its  mandate   Though  budgetary  allocations  to  CHRAJ  have  increased  substantially,  actual  disbursements  have   remained  low.  This  is  impeding  the  capacity  of  CHRAJ  to  effectively  execute  its  mandate.     The   constitutional   provision   (Article   218   of   the   1992   Constitution)   which   limits   CHRAJ   to   investigating   complaints   of   human   rights   abuses,   administrative   justice   and   alleged   corrupt   practices  of  public  officials  but  not  to  prosecute  has  not  been  reviewed.       39
