the national legislation will then be amended and adapted to the ratified convention. For
example, the provisions of the Protocol to the OAU Convention on Prevention and
Combating of Terrorism, Addis Ababa 2004 signed on 10 May 2006, have been
integrated into the Sahrawi Penal Code.

The Judiciary
Convinced that human freedom and dignity can only prevail in a country that
embodies and respects the rule of law, equality and respect for the fundamental human
freedoms and rights as defined by relevant provisions of the Constitution on ensuring
justice, the Sahrawi Republic has separated them from the remaining powers.
57.
Chapter three of part three of the Sahrawi Constitution on the Regulation of
Powers, has accorded great importance to justice through the following principles and
objectives:
The Judiciary in the Sahrawi Republic is independent and judicial powers
are exercised within the law;
Fair trial is guaranteed for all on the basis of legality, equality and respect
for law;
There are enough guarantees for fair trial, open proceedings, and
judgements are pronounced in public;
Citizens are equal before the law and have the right of habeas corpus
without discrimination;
The law protects litigants from any deviation or arbitrariness by the
Judiciary;
