Right to Freedom of Assembly and Association
16. The Commission commends Namibia for implementing Article 21 of
the Constitution which provides for freedom to assemble peacefully
and without arms and for freedom of association, including freedom to
form and join trade unions and political parties.
Due Process and Conditions of Detention
17. The Commission commends :
i. The efforts made by the courts to give effect to Article 12 (1) (e) of the
Constitution which states that “All persons shall be afforded adequate
time and facilities for the preparation and presentation of their defence,
before the commencement of and during their trial, and shall be
entitled to be defended by a legal practitioner of their choice”; by
declaring that the requirement of this Article include the right of an
accused person to be provided with the contents of the police case file
and testimonies of witnesses;
ii. The efforts made by the courts in guaranteeing the payment of
compensation to persons who have spent unlawful time in pre-trial
detention;
iii.
The implementation of the Commission’s recommendations by
operationalising the role of the visiting justices to the prisons as
provided in the prisons Act of 2012;
iv.
The measures put in place to curb overcrowding in Detention
centres including the use of alternative sources of sentencing such
as Community Service Orders for less serious offences and
construction of new prisons;
v.
The recreational, rehabilitation and educational facilities and
programmes available for prison inmates;
vi.
The three square meals provided to prisoners;
vii.
Providing access to free medical services including HIV/AIDs in
all correctional facilities;
viii. Providing access to a variety of hygiene products to prison
inmates;
ix.
Provision for prisoner family visitation rights by section 77 of the
Correctional Service Act of 2012.
