b) […] to protect effectively the right of a citizen to earn a dignified living in a freely chosen
occupation, profession or trade;
c) to promote vocational guidance and training;
d) to make and enforce statutory provisions for safe, healthy and fair conditions of work, including
reasonable rest, leisure, paid holidays, remuneration […] fair and equal wages for work of equal
value without distinction and stability of employment;
e) to promote negotiations between employers and workers with a view to the regulation of
conditions of employment […]
f) subject to such restrictions as are necessary in a democratic society and for safeguarding public
order, protection of health, morals and the rights and freedoms of others, to ensure the right of
workers to organise trade unions and to guarantee the right to strike".
In Seychelles 52.97 percent of the employees work in the private sector and 47.02
percent are employed in parastatal and public jobs. Laws have been enacted to
implement the rights of the workers established by this article of the Constitution
and in all cases the legislation provides for the procedure to deal with disputes
between employers and workers, their appeals and reviews.
The profuse legislation enacted for employment reflects the aim of the government
of protecting the rights of the workers in all the spheres. The Employment Act
supplies the rules regarding employment in general, together with its Regulations, the
Occupational Safety and Health Decree etc, and a specific body of rules for workers
on the public sector is been issued: the Public Service Orders.
Employment Act. 3/04/1995, Laws of Seychelles 1996
This Act has been enacted to revise and consolidate the law relating to employment,
into line with the policies determined by the Ministry for employment after
Consultation with Trade Unions and Employers Organisations, in consonance with
the Articles of the Constitution.
According to Section 4, it applies to contracts of employment for service in
Seychelles or on Seychelles ship or aircraft and contracts for service in an agency for
the government or diplomatic mission of Seychelles abroad.
