commonly known as the Convention on Certain Conventional Weapons (CCW) and to its protocols. It provides for the protection of civilians and civilian populations and for post-armed conflict measures. (o) The Protection of Elderly Persons Act was amended in 2016 to enhance the level of protection of, and security to the elderly. (p) The Protection from Domestic Violence Act was amended in May 2016 to provide for better protection to victims of domestic violence. (q) A new Data Protection Act was enacted in 2017 and came into force in January 2018. It provides for the protection of the privacy rights of individuals in view of the developments in the techniques used to capture, transmit, manipulate, record or store data relating to individuals. This new Act aligns the law in Mauritius with the EU General Data Protection Regulation (GDPR). Mauritius is the first country to align itself with the EU GDPR. (r) The Human Tissue (Removal, Preservation and Transplant) Act was enacted in 2018 to provide for a better legal framework for the removal, preservation and transplant of human tissue, other than blood, under appropriate medical supervision. (s) Amendments to the Information and Communication Technologies Act were brought in 2018 to strengthen the existing provisions in relation, inter alia, to online material that could cause “inconvenience, distress or anxiety.” (t) The Acquisitive Prescription Act was enacted in November 2018 to repeal the Affidavits of Prescription Act and the Affidavits of Prescription Act (Suspension of Certain Provisions) Act. It provides for a new and more appropriate legislative framework with better safeguards regarding acquisitive prescriptions. However, this Act is not yet in operation. 24
