East African Community Court of Justice Rules of Procedure, 2019. Verification of pleadings. 46. Every pleading shall be verified at the foot by the party or by one of the parties pleading or by some other person proved to the satisfaction of the Court to be acquainted with the facts of the claim or reference. Striking out pleadings. 47. (1) The Court may, on application of any party, strike out or expunge all or part of a pleading or other document, with or without leave to amend, on the ground that the pleading or other document:— (a) may prejudice or delay the fair trial of the case; or (b) is scandalous, frivolous or vexatious; or (c) is an abuse of the process of the Court. (2) An application under this rule shall state concisely the grounds on which it is made. SECTION VIII AMENDMENT OF PLEADINGS General power to amend. 48. For the purpose of determining the real question in controversy between the parties, or of correcting any defect or error in any pleading, a party may amend its pleading:— (a) without leave of the Court, before the close of pleadings; (b) with the consent of all parties, and where a person is to be added or substituted as a party, that person’s consent; or (c) Amendment of documents. with leave of the Court. 49. (1) A party entitled or given leave to amend a pleading may amend the original document itself or lodge an amended version of the document. (2) The amendment shall be by:— 30
