Rules of Procedure, 2019.
“Judge” means a Judge of the Court serving on theFirst
Instance Division or the Appellate Division;
“judgment” includes any decision, ruling or order made by
the Court;
“legal representative” means a person who in law represents
the interests of the estate of the deceased party, and
where a party sues or is sued in a representative
character, the person on whom the estate revolves on
the death of the party so suing or being sued;
“national Court” means a Court of competent jurisdiction
in a Partner State;
“national day” means such a day as designated by a Partner
State;
“notification” means a notice of claim or reference issued
by the Court in accordance with sub-rule (1) of rule
28 of these Rules;
“official holiday” includes the national days of the Partner
States as well as New Year’s Day, Idd el Fitr, Idd
el Haj, Good Friday, Easter Monday, Labour Day,
Christmas, Boxing Day and the EAC day;
“order” means the formal expression of any decision of the
Court which is not a decree;
“party” means any person who is appearing in any
proceedings before the Court as an appellant,
applicant, claimant, respondent, third party or
intervener;
“pleading” means any document lodged by or on behalf of
a party relating to a matter before the Court in which
the party sets forth or responds to allegations, claims,
denials or defences;
