34. Is the EACJ open to hear my complaints and views? In addition to taking any of the steps listed in the answers to Question 33 above, any person dissatisfied by the Judgment or order or decree of the Court can apply to the Registrar of the Court for a copy of it upon payment of a standard fee. 35. What are the roles and duties of Advocates before the Court and with their clients? An Advocate is a professional person who is legally qualified and licensed to give advice on legal matters including how to prosecute cases through the East African Court of Justice. An advocate representing a Party before the EACJ must be one who is entitled to appear before a superior court of a Partner State [Rule 17(5)]. The Court is not responsible for appointing Advocates nor does it get involved in the Advocate-Client relationship. Advocate - Client Costs Instruction fees The fee for instructions in suits and references are set out in the Second Schedule to the Court’s Rules. The taxing officer in his or her discretion may increase or reduce the fee. In proceedings in which no defence or other denial of liability is filed, or, in a reference where the value of the subject matter can be determined from the pleading, or the judgment or settlement between the parties – as between advocate and client the minimum fee is:x x x the fees increased by one third; or ordered by the Court, and increased by one-third; or the fees as agreed by the parties pursuant to the Court’s order or judgment, and then increased by one third, as the case may be, such increase to include all proper attendances on the client and all necessary correspondence. 25
