Pursuant to Section 3 of the Act two Statutory Instruments were passed, that is, Statutory Instrument No. 2 of 2002, which includes all types of employees and statutory instrument No. 3 of 2002, which relates to shop workers. 395. Section 4 of the Act provides that any employer who fails to comply with any statutory order made under this Act shall be guilty of an offence, and shall be liable, upon conviction to a fine not exceeding two thousand five hundred penalty units or to imprisonment for a term not exceeding 6 months, or to both. This is without prejudice to other rights that may exist at law for the employee. Employment of Young Persons and Children Act 396. Section 17 A of the Act prohibits the employment of young persons in employment of work detrimental to health, safety and morals. Factories Act 397. The Factories Act Chapter 441 makes provision for the regulation of conditions of employment in factories. It takes into consideration the safety, health and welfare of persons employed thereat. The Act emphasizes on the need for cleanliness, adequate ventilation, adequate lighting, sufficient and suitable sanitary conveniences, safety in the use of machines or dangerous substances, training and supervision of inexperienced workers, a safe design of the premises and fire fighting procedures. 153
