CHAPTER 10 Article 10 1. Every individual shall have the right to free association provided that he abides by the law. 2. Subject to the obligation of solidarity provided for in 29 no one may be compelled to join an association. 264. Individuals in Zambia have the right to form and belong to trade unions of their choice. A. LEGISLATIVE MEASURES The Constitution 265. Article 21 of the Constitution as stated in Chapter 21 provides for the right to freedom of association. Industrial and Labour Relations Act Trade Unions 266. Section 5 of the Industrial and Labour Relations Act (Amendment) Act, No. 30 of 1997 provides for the rights of employees in respect of trade union membership and its activities. It states: “Notwithstanding anything to the contrary contained in any other written law and subject only to the provisions of the Constitution and this Act, every employee shall have the following rights: a) the right to take part in the formation of a trade union; b) the right to be a member of a trade union of that employee’s choice. 112
