D. Right to education

Article 17 of the African Charter states that “1. Every individual shall have the right to
education.
2. Every individual may freely take part in the cultural life of his community.
3. The promotion and protection of morals and traditional values recognized by the community shall
be the duty of the State”.

Article 38 of the Constitution of the Republic of Chad stipulates that: “parents have the
natural right and duty to raise and educate their children. They are supported in this task by the State
and Decentralized Local Governments”.

Articles 35 et seq. of the Constitution stipulate that “Every citizen has the right to education;
public education is secular and free; private education is recognized and exercised under the
conditions set forth by law; basic education is compulsory”.

Act No. 16/PR/2006 establishing guidelines for the national education system guarantees: “1.
The right to education and training is recognized for all irrespective of age, gender, geographic,
social, ethnic or religious origin.
2. Education is a top national priority.
3. The State guarantees basic education for all from six (6) to sixteen (16) years of age.
